We are BPL Bioproducts Laboratory GmbH (“BPL”, “we” or “us”), a company registered in the Republic of Germany with company number HRB 103602 and have our registered office at Dornhofstrasse 34, 63263 Neu-Isenburg, Germany.

This website (the “Microsite”) relates to the product Coagadex®.

Use of the Microsite

By using the Microsite, you confirm that you accept these terms of use and agree to comply with them. If you do not agree to these terms, you should not use the Microsite.

We recommend that you print a copy of these terms for future reference.

Our privacy policy also applies to your use of the Microsite.

We use cookies on the Microsite in accordance with our cookie policy.

We may make changes to these terms

We may change these terms from time to time without notice, and as we deem necessary.  Every time you wish to use the Microsite, please check these terms to ensure you understand the terms that apply at that time.  These terms were most recently updated on October 2020.

We may make changes to our site

The Microsite and its contents are made publicly available free of charge. We may update and change the Microsite from time to time to reflect changes to Coagadex® and how it is supplied, distributed and administered, the needs of patients and our business priorities.

We cannot guarantee uninterrupted to the Microsite, or to any websites to which it links.  We may suspend or withdraw or restrict the availability of all or any part of the Microsite for business and operational reasons, at any time.

You are responsible for ensuring that all persons who access the Microsite through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

The Microsite is for use by persons residing in the European Union. We do not represent that content available on or through the Microsite is appropriate for use or available in other locations.

How you may use material on the Microsite

You will be able to access and, where applicable, download materials and other content from the Microsite. The content on the Microsite is subject to the copyright of BPL and its group companies unless otherwise indicated. Copyright material of BPL and/or its group companies (“BPL Works”) may not be reproduced except for your personal use. You must not modify the paper or digital copies of any materials you have reproduced in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Where any BPL Works are being republished or copied to others, the source of the material must be identified and the copyright status acknowledged. The permission to reproduce BPL Works does not extend to any material on the Microsite that is identified as being the copyright of a third party. Authorisation to reproduce such material must be obtained from the copyright holders. We are the owner or licensee of all intellectual property rights used on the Microsite, and in the material or other content published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

BPL encourages users to establish hypertext links to the Microsite. You must not use any part of the content on the Microsite for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use the Microsite will cease immediately and you must, at our request, return or destroy any copies of the materials you have made.

Logos

Copying our logos and any other third party logos accessed via the Microsite is not permitted without our prior approval or that of the relevant copyright or trade mark owner.

Obtaining further medical advice

You should obtain appropriate medical or professional advice before taking, or refraining from, any action on the basis of the content on the Microsite. You should when using Coagadex® follow all recommendations of your doctor or physician.

Although every effort is taken to ensure that the information contained on the Microsite is both accurate and complete, we make no representations, warranties or guarantees, whether express or implied, that the content on this Microsite is accurate, complete or up to date.

We are not responsible for websites we link to

All links from the Microsite are selected using our links policy. Links are provided for information and convenience only. We cannot accept responsibility for the sites linked to, or the information found there. A link does not imply an endorsement of a website; likewise, not linking to a particular site does not imply a lack of endorsement. We have no control over the contents of those sites or resources.

You do not have to ask permission to link directly to pages hosted on the Microsite. However, we do not permit our pages to be loaded into frames on any other website. The pages must load into the user’s entire window. You must not use the BPL logo to link to the Microsite without our prior permission.

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business:

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Furthermore, nothing in these terms is intended to or does limit or restrict our responsibilities or those any of our group companies as the market authorisation holder for Coagadex®.

If you are a healthcare professional:

We exclude all implied conditions, warranties, representations or other terms that may apply to the Microsite or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, the Microsite; or
  • use of or reliance on any content displayed on or accessible from the Microsite.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

If you are a patient:

Please note that we only provide our site for domestic and private use.  You agree not to use the Microsite for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

How we may use your personal information

We will only use your personal information as set out in our privacy policy.

We are not responsible for viruses and you must not introduce them

We make every effort to check and test material at all stages of production. It is always wise for you to run an anti-virus programme on all material downloaded from the internet.

We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system that may occur while accessing or using material derived from the Microsite. We do not guarantee that the Microsite will be secure or free from bugs or viruses.

Rules about linking to the Microsite

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to the Microsite in any website that is not owned or controlled by you.

The Microsite must not be framed on any other site, nor may you create a link to any part of this Microsite other than the home page.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the content standards set out in the Acceptable Use section below.

Acceptable Use

You must:

  • not use the Microsite in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the Microsite or any operating system;
  • not infringe our intellectual property rights or those of any third party in relation to your use of the Microsite (to the extent that such use is not licensed by these terms);
  • not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Microsite;
  • not use the Microsite in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
  • not collect or harvest any information or data from the Microsite or our systems or attempt to decipher any transmissions to or from the servers running the Microsite.

Failure to comply with this section may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use this Microsite.
  • Issue of a warning to you.
  • Legal proceedings against you.
  • Disclosure of such information to law enforcement and/or relevant regulatory authorities in such country as we reasonably feel is necessary or as is required by law.
